			<content:encoded><![CDATA[<p>So-called &#8220;service&#8221; cars (whether of the Cars and private passenger or commercial type) used by Towing Automobile Sales Agencies, Public Garages, Repair Shops (if not already covered by a garage policy) and by Automobile Service Stations and Tire Dealers for first aid to disabled automobiles or for towing same, shall be written at the premiums for &#8220;light&#8221; Class 3 commercial automobiles. Omnibus coverage may be granted in connection with service cars except when insured under garage payroll policies.</p>
<p><span id="more-271"></span></p>
<p><a href="http://www.discountautoinsurances.org/discount-auto-insurance-online/">Discount Policies</a> may be issued to cover the auto-Schools mobile operations incidental to so-called auto mobile or tractor training schools or colleges. Such risks shall be referred to the Company for rating on proper application blanks filled out and signed by the assured. Tire Dealers and Battery Service Stations the Dealers and operations of which involve the driving of customers&#8217; cars, may be insured for Public Liability Station and Property Damage under Garage Payroll policies covering all operations except owned automobiles which shall be specifically excluded and insured  separately at full Manual rates. Garage Payroll policies issued to cover such risks shall be written for &#8220;Total Hazard&#8221; Coverage only, at the automobile storage garage payroll rates and minimum premiums for &#8220;Total Hazard.&#8221;</p>
<p>Automobile Filling Stations shall be insured Filling for premises hazard in accordance with the Stations public Liability Manual (Garage Payroll policies shall not be used). Risks which involve calling for and delivering customers&#8217; cars may be insured for such operations on the Named Driver basis at the demonstrating rates. If it is impossible to name the persons who drive customers&#8217; cars, the risk shall be submitted for rating.</p>
<p>Companies Crating rates for Public Liability and Property Damage Coverage for the repossessing or recovering of financed cars. If it is impossible to name the persons who repossess financed cars, the risk shall be submitted for rating on the basis of the number of cars repossessed. Owned automobiles used in the business shall be insured in the regular manner.</p>

In consideration of the additional premium of this policy is extended to cover the legal liability as defined therein of whose salary is included in the payroll upon which the premium for this policy is based, while any automobile owned by or in charge of the named garage, other than, an automobile owned by said person or by a member of his family, is being operated by the said person (or by any person when accompanied by him or while being operated with his consent) for the purposes described in the policy and for private and pleasure purposes.&#8221;</p>
<p>A garage policy issued on the &#8221; Payroll Basis&#8221; Members of may be extended at the rates shown on the Rate Families) Sheets in this Manual for &#8220;Additional Assured —Employees and Others,&#8221; to cover the personal liability of a member of the family of any employee, proprietor or executive officer of the garage. An endorsement to the following effect shall be used:</p>
<p>In consideration of the additional premium of this policy is extended to cover the legal liability as defined therein of while any automobile owned by or in charge of the named garage, other than an automobile owned by the person named below or by a member of his family, is being operated by said named person (or by any person when accompanied by him) for the purposes described in the policy and for private pleasure purposes. It is further understood and agreed that said person named above is a member of the family of who is an. officer, partner, member of the firm, or employee of the assured named in the policy and whose salary is included in the payroll upon which the premium for this policy is based.</p>
<p>Automobiles owned by officers, employees or members of their families, whether or not used in connection with the business of the garage, cannot be included in the additional assured coverage of a garage policy. Such automobiles must be separately insured at full Manual rates. See &#8220;Demonstrating or Testing&#8221; rule for rates to charge if the car is used for demonstrating or testing purposes.</p>
<p>Note: Premiums for additional assured coverage are not subject to modification by merit or experience rating.</p>

(Proprietors and A garage policy issued on the Payroll Basis Executes covers without extra charge the personal liability of the owner, partner, president, vice-president, secretary or treasurer of such garage, provided such persons are specifically named in the policy or endorsement and that the salaries of such named persons are included in the payroll forming the basis of computing the premium for the policy as provided in the &#8220;Garage Payroll Policies Defined&#8221; Rule, and further provided that the coverage extended to such named person is limited to the operation (business and pleasure) of any automobile owned by or in charge of the garage, other than an automobile owned by a member of his family or by said partner, president, vice-president, secretary or treasurer.</p>
<p>If the risk is a co-partnership this coverage applies only to automobiles owned by the co-partnership. Automobiles personally owned by the members of a co-partnership whether or not used in connection with the business of the garage must be insured on separate policies at full Manual rates; likewise automobiles personally owned by officers.<br />
A garage policy issued on the Payroll Basis extended for an additional premium, determined as hereinafter provided, to cover the pc, sonal liability of all employees of the garage, including proprietors and executive officers, whose remuneration is included in the payroll forming the basis of computing the premium for the policy as provided in the &#8220;Garage Payroll Policy Defined&#8221; Rule, without specifically naming the employees, proprietors or executive officers. This extended coverage shall be granted by an endorsement to the effect^ that each employee, proprietor or executive officer so covered is protected only for the operation (business and pleasure) of any automobile owned by or in charge of the garage, other than an automobile owned by a member of his family or by the employee, partner or executive officer. Automobiles owned by partners, executive officers and other employees must be insured separately at the full Manual Rates.</p>

The policy shall cover the assured&#8217;s legal liability for injuries to, or death of, any person (excluding employees while in the course of their employment) or damage to property of others, caused during the policy term within the limits of the United States and Canada, by any automobile manufactured or assembled and sold by the assured, or by any automobile repaired by the assured: such personal injury or property damage being due to or alleged to have been due to a defect in the material, assembling or repair of said automobile; excluding, however, liability for damage to or destruction of the automobile itself.</p>
<p>The policy shall require the assured not to enter into any contract, agreement or understanding tending to deprive the company of its subrogation rights against parts&#8217; manufacturers. The assured shall also agree to keep an accurate record of all automobiles manufactured or repaired.</p>
<p>This form of insurance shall comply with the general rule that no policy shall be written to cover for a longer term than one year.</p>
<p>Refer all such risks to the Company for rating. (Manufacturers For Defect Coverage for manufacturers of Other Auto- automobile parts, refer to the Public Liability mobile Parts) Manual.</p>
<p>A policy issued on the &#8220;named driver&#8221; or &#8220;specified car&#8221; basis shall not name more than one assured, except at an extra charge of 5% for one additional named assured, VA% for two additional named assured, and 10% for three or more additional named assured; such percentage to be based on the Public Liability and Property Damage premium but not on the Collision premium.</p>

<p>Automobiles owned by officers, employees and others shall not be included in the policy covering the factory. Such automobiles must be separately insured at full Manual rates.<br />

Individual purchasers who go to the auto mobile factory or branch after their own automobiles and drive them away may be covered for Public Liability, Property Damage and Collision insurance in the regular manner, by having the policy commence at the time the automobiles are received at the factory or branch.<br />
The dealer or garage that already carries Public Liability and Property Damage insurance on the &#8220;payroll&#8221; basis is covered for all incidental &#8220;drive-away&#8221; hazards; it being understood, of course, that the salaries of all chauffeurs conducting the &#8220;drive-aways&#8221; are included in the payroll policy.</p>
<p>The special contractor, whose business consists in driving away automobiles for dealers or for factories, may be insured for Public Liability and Property Damage either on the Specified Car or Named Driver basis (but not Payroll basis) at the &#8221; Y&#8221; premiums for Private Passenger Cars and at the Medium Class 4 premiums for Commercial Cars prevailing in the highest rated territory through which the automobiles will be driven away. Policies written for a short term are subject to the regular short rate charges.</p>
<p>Where &#8220;drive-aways&#8221; are conducted by the automobile manufacturer, Public Liability and Property Damage coverage for same are provided for in the rating procedure for factory testing risks. See &#8220;Automobile Factories&#8221; Rule.</p>

<p>The policy shall not extend to cover the operation of any branch sales office or garage. Each such branch sales agency or garage must be rated under the rules applying to automobile garages, sales agencies and service stations.</p>
<p>The standard automobile policy form shall be used to cover the private type and commercial automobiles used in the business of the assured (referred to under B) and an endorsement to the following effect shall be attached to the policy to provide coverage for the Testing Hazard (referred to under A).</p>
<p>&#8220;In consideration of the premium herein provided and based on the actual number of automobiles manufactured, assembled, repaired or rebuilt by the assured during the policy period which have so far proceeded in the process of manufacture, assembling, repairing or rebuilding as to be capable of use under their own power, it is hereby agreed by and between the named assured and the company that this policy is extended to cover the legal liability of the assured in connection with the (1) testing at or from the factory of the assured of any automobile manufactured, assembled, repaired or rebuilt by the assured (including laboratory models), (2) the driving away or delivery of automobiles manufactured, assembled, repaired or rebuilt by the assured commonly known as &#8216;drive-aways&#8217;, (3) the liability of the assured in connection with the operation and use in the named assured&#8217;s business of any automobile not owned by the assured nor licensed in his name nor directly hired by him.</p>
<p>&#8220;Nothing contained in this endorsement or in the policy to which it is attached shall be construed to cover the liability, of any person, firm or corporation other than the named assured for the operation of automobiles under the provisions of this endorsement.&#8221;</p>

The additional rate to be charged shall be one-half the total hazard Property Damage rate for the garage payroll risk, with an additional minimum premium charge equal to the total hazard property damage minimum premium requirement; the company&#8217;s liability to be limited to the amount stated in the policy, this limit to apply to each accident and not to each object damaged in the accident.</p>
<p>Coverage for damage to property in charge of electric garages and storage garages may be provided on this basis at an additional rate equal to the total hazard Property Damage rate for a regular garage in the territory subject to a minimum premium equal to 150% of the total hazard Property Damage minimum premium for a regular garage in the territory.</p>
<p>The basis of writing the risk is divided as follows:<br />
A. Testing Hazard.<br />
(1)	The testing of any automobile (including laboratory models) manufactured, assembled, rebuilt or repaired by the assured.<br />
(2)	The driving away or delivery of automobiles manufactured, assembled, rebuilt or repaired by the assured.<br />
(3)	The liability of the automobile manufacturer in connection with the operation of any automobile not owned by him nor licensed in his name nor hired directly by him, but used in connection with his business.<br />
Omnibus coverage is not permissible.</p>
<p>The rates are established from information furnished on the application blank and are based on the factory output of automobiles which includes the total number of automobiles manufactured or assembled during the policy period plus the total number of automobiles repaired or rebuilt at the factory during the policy period all subject to a minimum premium.</p>

A blanket policy may be issued to cover an automobile dealer for all automobiles owned by him at the beginning of the policy year and at all times during the policy period, at the rates and minimum set forth in the Miscellaneous Rate Section, subject to the &#8220;Drive-Away&#8221; and other exclusions outlined above. Such policy shall contain a declaration as to the number of automobiles owned by the assured at the time the policy takes effect and the number contracted for or to be purchased by the assured during the policy year. He shall keep a record of the date each car comes into his possession, and shall promptly notify the company thereof.</p>
<p>Likewise, he shall promptly notify the company of the date each car is disposed of. The assured shall pay an advance premium equal to the total number of automobiles to be insured during the year at the minimum premiums for each such automobile as given in the Miscellaneous Rate Section. Policy may be written on a semi-annual, quarterly or monthly audit and premium payments based thereon, in which event the company shall render a statement at the end of each period of the Collision premiums due for cars insured during such period and same shall be due and payable forthwith by the assured. The deposit premium paid by the assured at the time the policy is written shall be held by the company to be applied against the amount due for the last period of the policy.</p>

Automobiles of the commercial type written on either the &#8220;named driver&#8221; or &#8220;specified car&#8221; basis, which are occasionally used for general trucking, shall be written at the &#8220;Truckmen&#8221; commercial car premium where such premium is higher than the Demonstrating Premium.</p>
<p>Collision insurance for public garages and automobile manufacturers may be obtained by specifying in the policy each automobile to be covered and applying the rates and minimums. An alternative method is provided for automobile dealers (not automobile manufacturers); see instructions below under caption of &#8220;Blanket Collision Policy for Dealers.&#8221;</p>
<p>Under either plan coverage shall exclude protection while the insured automobile is being &#8220;driven away&#8221; under its own power from the factory, assembly plant or other distributing point, to or part way to, the assured&#8217;s salesroom, warehouse or other receiving point, unless an additional premium is paid therefor in accordance with the charges and minimum set forth in the Miscellaneous Rate Section for &#8220;Drive-Aways.&#8221;</p>
<p>Policies shall also exclude coverage while the insured automobiles are being used to carry passengers for a consideration or are rented for a consideration. (For such automobiles charge the Collision rates for &#8220;Public Automobiles&#8221;.) Provision shall be made that indemnity for damage repaired by the assured shall not be in excess of the actual cost of labor and material. <p>Limits are based upon limits of $5,000 for one person and $10,000 for any one accident unless otherwise specifically indicated. No reduction is allowed for lower limits, unless special exception is made. For higher limits, charge additional percentages of the basic rates and minimum premiums.</p>
<p>Property rates and minimum premiums for Property Damage</p>
<p>Damage Insurance include &#8220;loss of use&#8221; and are based upon a limit of $5,000 unless otherwise specifically indicated. No reduction is permitted for lower limits or for the exclusion of &#8220;loss of use.&#8221; The Company&#8217;s liability for one accident (including claims from resultant &#8220;Loss of Use&#8221;) shall not exceed the limits stated in the policy. The automobile policy may contain a pro- or Insolvency vision to the effect that the insolvency or of Assured bankruptcy of the assured thereunder shall not release the Company from the payment of damages for injuries sustained or loss occasioned during the life of the policy, and in case execution against the assured is returned unsatisfied in an action brought by the injured, or his or her personal representative in case death results from the accident, because of such insolvency or bankruptcy, then an action may be maintained by the injured person or his or her personal representative against the Company under the terms of the policy for the amount of the judgment in the said action, not exceeding the limits of the policy.</p>
<p>The terms and conditions of this policy are so extended as to be available, in the same manner and under the same conditions as they are available to the named assured, to any person or persons while riding in or legally operating any of the automobiles described in the declarations, and to any person, firm or corporation legally responsible for the operation thereof, provided such use or operation is with the permission of the named assured, or, if the named assured is an individual, with the permission of an adult member of the named assured&#8217;s household &#8216;other than a chauffeur or a domestic servant; except that the terms and conditions of this policy shall not be available to a public automobile garage, automobile repair shop, automobile sales agency, automobile service station, and the agents or employees thereof.</p>
